The problems foreigners actually bring us
Not an exhaustive list of practice areas, just the things that come through the door most, and what the law says about each.
"I want to buy property here"
A foreigner cannot hold freehold. The nominee structures still sold as a workaround are void under Article 26(2) of the Basic Agrarian Law, the land falls to the State, and the statute expressly bars recovering what you paid. Indonesian courts have voided these repeatedly and we found no case where a foreigner recovered the land. What does work: Hak Pakai, a properly drafted lease, or a strata title.
"I want to set up a company"
Possible, but Bali blocked 64 business classifications to foreign investment companies in May 2026. The first question is whether your activity is still available at your location, not how fast it can be registered.
"I need a visa or my KITAS is expiring"
Overstay is Rp 1,000,000 per day and becomes deportation with a ban of up to 10 years at 60 days. Since May 2025 applications need in-person biometrics.
"I have been in an accident"
Indonesia handles traffic accidents through the criminal system, not as an insurance matter. Paying the other party does not end a criminal case where someone was injured, and you can be barred from leaving the country while it proceeds. See your rights after an accident.
"I am married to an Indonesian"
Land held by an Indonesian married to a foreigner is excluded from joint marital property only where there is a notarial separation-of-property deed. Without one, the foreign spouse's interest contaminates the title and a one-year divestment clock starts.
"I am building something"
The PBG must come before construction and the SLF before use. Badung recorded 194 building violations in 2025 with 35 businesses sealed, and 48 buildings were demolished at Pantai Bingin. Holding an NIB and KKPR is not enough.
"I need documents legalised"
Indonesia joined the Apostille Convention in June 2022. One certificate replaced a chain of four or five authentications, and the government fee is Rp 150,000.
When a lawyer changes the outcome
Plenty of Indonesian processes are administrative and you can do them yourself. These are the moments where advice genuinely changes what happens:
- Before money moves on property. Nearly every problem we see was visible on the certificate beforehand.
- When a structure is sold to you as clever. The common ones have been voided by courts for decades.
- When you are asked to sign in Indonesian. Agreements with an Indonesian party must be in Bahasa Indonesia, and an English-only contract has been struck down as void.
- When you are named as a suspect. Exit bans run six months and are renewable.
- When a regulatory deadline is running. Six months for a Jasa Raharja accident claim, two years to renew an expired HGB, one year to divest inherited freehold.
